Yesterday, the US Trustee filed a lawsuit against the Giudices, to block their bankruptcy discharge.  Attached is a copy.  A predictable response to the complaint will be, at least initially, these are only allegations. However you will note that the allegations are all based on the Giudices’ own sworn testimony and their own documents.

No new episode of The Real Housewives of DC aired last night to the disappointment of many fans.  Apparently it was due to the Labor Day weekend but it really makes no sense because I doubt that a Thursday airing would have affected ratings all that much.  Even stranger is that Bravo will air the New Jersey reunion on Labor Day, go figure? 

Mary Amons from DC took to Twitter last night just to ensure fans that they’ll be back next week with a new episode, a little tweet conversation I had with Mary…

Clearly from Mary’s first tweet, she was looking for fans to bash Michaele, I had no intention of doing that with Mary, that’s for sure so I thought I’d call her out on her own behavior.  Mary goes on to tell us that she is “about” honoring and building people.   Well, we haven’t seen much evidence of that at all! 

The rumors are flying fast and furious, some pretty reliable sources are reporting that there is already a new member of the New Jersey Housewives cast  and she’s already been filming for the show!

Teresa’s sister- in-law Melissa Gorga, married to Teresa’s brother is New Jersey’s newest victim.   Reports claim that Melissa has been interested in becoming a Bravo Housewife since they began the New Jersey franchise but Teresa Giudice has put the brakes on her aspirations.  Now that Dina is gone and most likely Danielle as well, the show needed some fresh blood.  Sticking with the New Jersey theme, another family member was recruited to fill the void.

Reports are that Melissa’s baby is the nephew that Danielle was referring to at the reunion of the RHONJ that caused Teresa to go bat shit crazy and scream in Danielle’s face.  Teresa has been talking to as many media outlets as she could get her hands on since the airing with her story of her nephew’s birth.  Teresa is claiming that she was present for the child’s birth and even missed her scheduled Bravo Talk Bubble chat that evening so that she could be at the hospital.  But Jacqueline, in her attempts to help Teresa with her story, actually contradicted Teresa’s claim and tweeted that Teresa had been with her in California at the time but visited the baby as soon as she returned to New Jersey.

The day after, according to Jacqueline, Teresa’s story is that she was there for the birth and that is why she missed the Talk Bubble…. They really should get together and get their story straight before they put it out there.

I completely believe the stories that Teresa does not like her sister-in-law, Melissa.  There are so many things that would make Teresa jealous, Melissa has a baby boy, Melissa has more money than the Giudice’s, Melissa has a bigger home than Teresa and Joe, Melissa is much better looking than Teresa, and the list goes on…. 

Teresa is talking to the press so much that it is almost as if she’s trying too hard to dispel the rumors, thou might just protest too much Teresa! 

Teresa is rumored to be holding out for more money before signing on for another season of RHONJ, but it is also reported that while she wants more money, more freedom to do outside projects and a cut of the sale of the DVD’s and residuals, it is also rumored that Teresa refuses to continue with the show while her sister in law Melissa is a cast mate. 

Bravo usually gets what they want and they clearly want Teresa as a cast member of RHONJ, but the fact that they’ve begun filming with Melissa has seriously cut into Teresa’s bargaining power.

Does anyone remember Bravo’s “Kell On Earth”?  The unsuccessful series followed PR Firm People’s Revolution and owner Kelly Cutrone from New York to Los Angeles to London and back.  As the series wound down, its cast took to Twitter to Tweet HARD for another season, they encouraged fans to write in to Bravo, practically begging for another season. 

Apparently that campaign was unsuccessful, and Kelly Cutrone couldn’t be bitterer, here are her tweets:

If Kelly Cutrone can’t BE on Bravo, apparently she must SLAM Bravo, but notice she is still WATCHING Bravo!   She always did seem to be a wild card with a quick temper, would have been more professional just to say nothing and move on.  Burning bridges is never a good idea. 

Bravo has released a few preview video’s for the Real Housewives of Beverly Hills, they’re just a bunch of crazy bitches just like any other city, family members, drama, husbands and kids but folks, these ladies are the real deal, they have the big money that this series was originally based on.  I’m going to go out on a limb here and say that we probably won’t see any of these ladies homes in short sale or filing bankruptcy anytime soon.  You can watch their video’s here:

Each of the ladies were asked who their favorite housewife is from other shows, they didn’t all answer the question but they all admitted to watching the Housewives.   Here is my first impression of the six Beverly Hills Housewives:

Adrienne looks like a train wreck at first glance, she claims to put her children first and everything else secondary but also says that she can relate to Jill Zarin the most so she immediately lost points with me!  Her family is in the sports entertainment business and she works alongside them, her voice sounds like she may be a long time smoker or possibly she just needed to clear her throat throughout the interview.

Taylor seems like the fun girl and said that she related most to Bethenny, Jill and Luann from New York.  I’m still reserving judgment on this one.

Camille was married to Kelsey Grammar and does talk a bit about her divorce, she and her husband produce television shows including “Medium” and “Girlfriends”.  She openly states that she doesn’t know what will happen to the production company after the marriage is dissolved.  Camille claims that not only did her husband Kelsey encourage her to join the show but called the production company promising them filming access to some of his productions.  She refused to mention one housewife but said she could relate to all of the Orange County ladies.

Kyle tells the camera that she was a “child actress her entire life”.  Really?  I think we found the Kelly of the bunch, but she also claims to be a friend of Bethenny’s so she can’t be all bad.  She said that she relates mostly to the ladies of Orange County and New York.  She’s also sure to tell us that she’s Paris Hilton’s aunt.  I’m sure her other nieces and nephews weren’t too offended. 

Lisa has a Jill size obsession with her dogs and her children are grown and out of the house.  She owns a couple of restaurants and tells us that NeNe has visited her restaurant on several occasions, she also reveals that NeNe seemed to be making fun of some of the housewives who have had plastic surgery but most recently has come into her restaurant sporting a new nose! 

Kim is completely obsessed about having been a child star and goes into great detail about every TV show and movie that she’s been in.  Sorry, Kim, I’ve never heard of you.  She talks about how she wasn’t able to go anywhere without press following her and is excited about getting that back.  She claims to have retired to raise a family, however, I think we all know that many child stars are done as soon as they grow breasts.  Kim related most to Tamra from Orange County.

All six of the ladies seem to think that Beverly Hills is the best of the best when it comes to Housewife cities, New Jersey wasn’t even mentioned in any of their interviews, not surprisingly they probably like to pretend it doesn’t exist so as not to attach themselves to it in anyway. 

They spoke of the major differences between New York City and Los Angeles, no surprises there, none of them had anything bad to say necessarily but we all know how very different these two cities are.  Mostly, they seemed to want to set themselves apart from Orange County.  I think these were prompted by producers as they questioned the ladies as they seemed to want to provide viewers with distinct differences between life in Orange County and life in Beverly Hills as I think some housewives fans have criticized Bravo for producing two different series in two cities that are so close to one another.

Those are my first impressions, I’ll be interested to see after a few episodes if these have changed, and I’m sure that they will.  What do all of you think of these ladies so far?  Will you be watching?

COMPLAINT OBJECTING TO DISCHARGE

Roberta A. DeAngelis, the United States Trustee, Region 3 (“UST”), having a

post office address at One Newark Center, Suite 2100, Newark, NJ, 07102, by and

through counsel, by way of complaint objecting to the discharge of Giuseppe Giudice and

Teresa Giudice (“Defendants”), respectfully alleges as follows:

JURISDICTION AND VENUE

1. This is an adversary proceeding brought under 11 U.S.C. § 727(c) and

Federal Rule of Bankruptcy Procedure 7001(4).

2. This Court has jurisdiction over this matter pursuant to 28 U.S.C. §§ 157

and 1334.

3. This is a core proceeding over which this Court has jurisdiction pursuant

to 28 U.S.C. § 157(b)(2)(A) and (J).

4. Venue is proper pursuant to 28 U.S.C. § 1409.

5. The UST has standing to bring this complaint under 11 U.S.C. § 307 and

28 U.S.C. § 586(a)(3).

6. This complaint is timely filed as the original deadline for filing a

complaint objecting to discharge was extended by order of this Court pursuant to Federal

Rule of Bankruptcy Procedure 4004(b) to March 1, 2010, then to May 3, 2010, and

finally to September 3, 2010.

FACTUAL BACKGROUND

The Defendants’ Original Filings

7. On October 29, 2009, the Defendants filed a voluntary petition for relief

under chapter 7 of title 11 of the United States Code, with accompanying Schedules,

Statement of Financial Affairs, and other required documents.

8. The Defendants disclosed three properties on Schedule A: their primary

residence at 6 Indian Lane, Towaco, NJ, valued at $1.7 million; 86 Pine Brook Road,

Lincoln Park, NJ, valued at $200,000; and 49 Sylvia Lane, Stafford, NJ, valued at

$337,000.

9. The Defendants disclosed interests in three businesses on Schedule B: 6

Glenwood Avenue Associates, LLC; 168 South Clinton Street Associates, LLC; and 17

Webster Place Associates, LLC.

10. The Defendants did not disclose any bank accounts on Schedule B.

11. The Defendants did not disclose any vehicles on Schedule B.

12. The Defendants did not disclose any “other contingent and unliquidated

claims of every nature” on Schedule B.

13. The Defendants did not disclose any interest in “patents, copyrights, and

other intellectual property” on Schedule B.

14. The Defendants did not disclose any “other personal property of any kind

not already listed” on Schedule B.

15. The Defendants disclosed $6,127,454.51 in total unsecured debts on

Schedule F.

16. The Defendants stated on Schedule I that as of the petition date Defendant

husband received $3,250 in gross monthly income as owner of G&G Stucco & Stone

Specialist, Inc., plus an additional $10,000 in monthly assistance from family members.

17. The Defendants further stated on Schedule I that as of the petition date

Defendant wife was unemployed, but received $3,333.33 in monthly “income from

Bravo.”

18. Upon information and belief, Defendant wife is one of the stars of the

reality television show “Real Housewives of New Jersey,” which has aired on the Bravo

cable television network since May 2009.

19. The Defendants indicated on Schedule I that as of the petition date they

did not anticipate any increase in income within the year following the filing of their

petition.

20. The Defendants signed the Declaration Concerning Debtor’s Schedules

attesting under penalty of perjury that the information contained in the Schedules was

true and correct.

21. The Defendants disclosed on their Statement of Financial Affairs that their

gross income from employment, trade, profession, or operation of business totaled

$575,000 in 2008, $598,000 in 2007, and $312,000 in 2006.

22. The Defendants did not disclose on their Statement of Financial Affairs

any year-to-date gross income for 2009.

23. The Defendants did not disclose on their Statement of Financial Affairs

any income other than from employment, trade, profession, or operation of business

during the two years preceding the filing of their petition.

24. The Defendants disclosed on their Statement of Financial Affairs interests

in five businesses: 168-170 South Clinton Street Associates, LLC; 17 Webster Place

Associates, LLC; 6 Glenwood Avenue Associates, LLC; G&G Realty Holding, Inc.; and

G&G Stucco & Stone Specialist, Inc.

25. The Defendants indicated on their Statement of Financial Affairs that,

during the year preceding the filing of their petition, they made no gifts, incurred no

losses, and transferred no assets outside of the ordinary course of business.

26. The Defendants signed the statement at the end of the Statement of

Financial Affairs attesting under penalty of perjury that the information contained in the

Statement of Financial Affairs was true and correct.

The Defendants’ Initial Amendments

27. In a letter dated November 18, 2009, that was mailed to John Sywilok,

Esq., the panel trustee appointed in this case (the “Case Trustee”), and was also mailed to

the Defendants’ attorney, counsel to secured creditor Wachovia Bank, N.A. raised several

discrepancies in the Defendants’ Schedules and Statement of Financial Affairs.

28. The discrepancies included, but were not limited to, the Defendants’

failure to disclose ownership of 393 Lexington Avenue, Clifton, NJ and 399 Lexington

Avenue, Clifton, NJ.

29. On November 20, 2009, the Case Trustee sent a letter to the Defendants

requesting copies of their federal tax returns for 2006, 2007, and 2008; documents related

to all real property they owned; a list of their jewelry; 2007 and 2008 federal tax returns

for the entities identified on the Schedules filed with the petition; copies of bank

statements and cancelled checks for the Defendants’ bank accounts for the year leading

up to the filing of the petition; a list of all cash payments exceeding $750 made during the

year preceding the petition; copies of any contracts with Bravo Entertainment; and copies

of paystubs from April through November 2009.

30. Thereafter, on December 17, 2009, the Defendants amended several

Schedules and their Statement of Financial Affairs.

31. Amended Schedule A added the previously undisclosed properties at 393

Lexington Avenue, Clifton, NJ and 399 Lexington Avenue, Clifton, NJ.

32. Amended Schedule B added the Defendant husband’s previously

undisclosed checking account at Community Bank of Bergen County with a balance of

$1,000.

33. Amended Schedule B added three businesses that were not disclosed on

the initial Schedules: G&G Realty Holding, Inc.; G&G Stucco & Stone Specialist, Inc.;

and 1576 Maple Avenue Associates, LLC.

34. In addition, Amended Schedule B added three vehicles and a boat, which

had not previously been disclosed: a 2007 Cadillac Escalade V-8; a 2005 Ford F350 Long

Bed Truck; a Kawasaki Quad; and a 2004 Sea-DooBRP Sport Boat.

35. Amended Schedule F increased the Defendants’ total unsecured debts to

$7,165,832.43.

36. Amended Schedule G added a previously undisclosed lease for a 2005

Maserati Quattroporte.

37. The Defendants amended Schedule I to disclose that as of the petition date

Defendant wife had been employed for one month as an “Actress/TV Personality” by

Sirens Media, LLC, with $7,083.33 in gross monthly income.

38. The Defendants signed the Declaration Concerning Debtor’s Schedules

attesting under penalty of perjury that the information contained in the Amended

Schedules was true and correct.

39. The Amended Statement of Financial Affairs added a previouslyundisclosed

interest in a business named 1576 Maple Avenue Associates, LLC.

40. The Defendants signed the statement at the end of the Amended Statement

of Financial Affairs attesting under penalty of perjury that the information contained in

the Amended Statement of Financial Affairs was true and correct.

The Meeting of Creditors

41. The meeting of creditors pursuant to 11 U.S.C. § 341(a) (“Meeting of

Creditors”) was held on December 23, 2009.

42. The Defendants testified under oath that the information contained in the

Petition, Schedules, and Statement of Financial Affairs filed as of that date was true and

correct.

43. The Defendant wife testified that she does not hold interests in any

businesses.

44. The Defendants testified regarding the contents of documents purported to

be their 2006, 2007, and 2008 individual federal income tax returns, which had been

submitted to the Case Trustee prior to the Meeting of Creditors.

The Defendants’ Subsequent Amendments

45. On January 8, 2010, the Defendants filed a second Amended Statement of

Financial Affairs which, contrary to the Defendants’ testimony at the Meeting of

Creditors and the disclosures made in the initial and amended Statement of Financial

Affairs, indicated that they had received no gross income from employment, trade,

profession, or operation of a business, during the two years preceding the filing of their

petition.

46. The Defendants signed the statement at the end of the second Amended

Statement of Financial Affairs attesting under penalty of perjury that the information

contained in the second Amended Statement of Financial Affairs was true and correct.

47. On March 2, 2010, the Defendants filed a second Amended Schedule F

and a third Amended Statement of Financial Affairs.

48. The Second Amended Schedule F increased the Defendants’ total

unsecured debts to $7,192,723.47.

49. Of the total unsecured debt listed on the second Amended Schedule F,

$89,254.81 was attributable to consumer credit cards and store credit at Bloomingdale’s,

Neiman Marcus, and Nordstrom.

50. The Defendants signed the Declaration Concerning Debtor’s Schedules

attesting under penalty of perjury that the information contained in the second Amended

Schedule F was true and correct.

51. The third Amended Statement of Financial Affairs made no changes to the

Defendants’ disclosures regarding either the businesses they owned or their pre-petition

business income.

52. The Defendants signed the statement at the end of the third Amended

Statement of Financial Affairs attesting under penalty of perjury that the information

contained in the third Amended Statement of Financial Affairs was true and correct.

The Defendant Wife’s Rule 2004 Examination

53. On April 23, 2010, an examination held pursuant to Federal Rule of

Bankruptcy Procedure 2004 (“Rule 2004 Examination”) was conducted of the Defendant

wife.

54. The Defendant wife testified that she has a bank account with Lakeland

Bank, and she is the only person with signature authority on that account.

55. Defendant wife further testified that she owned a previously undisclosed

business by the name of TG Fabulicious, LLC, of which she is the sole member.

56. The Defendant wife also testified that she had a previously undisclosed

deal with Hyperion, an imprint of Buena Vista Books, Inc., to publish a previously

undisclosed cookbook titled “Skinny Italian.”

The Defendant Husband’s Rule 2004 Examination

57. On April 23, April 30, and May 26, 2010, a Rule 2004 Examination was

conducted of the Defendant husband.

58. The Defendant husband testified that prior to his employment with G&G

Stucco & Stone Specialist, Inc., for a three- to four-year period beginning in 2005 he

withdrew funds from his LLCs as needed.

59. The Defendant husband affirmed his signature on a mortgage application

dated July 23, 2008, which indicated that he received $54,269 in monthly income from

“G&G Stucco & Stone.”

60. The Defendant husband testified that the IRS informed him “three or four

or five months ago” that the purported 2006, 2007, and 2008 individual income tax

returns, which had previously been presented to the Case Trustee, were never actually

filed.

61. The Defendant husband also testified that he was the sole member of a

previously undisclosed business named 1601 Maple Avenue Associates, LLC, which

owns a parcel of real estate in Hillside, NJ, and collects rents from two commercial

businesses operating at that location.

Defendants’ Document Production Subsequent to the Rule 2004 Examinations

62. The Defendant wife produced a Certificate of Formation from the State of

New Jersey Department of the Treasury indicating that a business named TG Fabalicious,

LLC, was incorporated on April 20, 2009, with the only member listed as Teresa Giudice.

63. A Business Entity Amendment Filing with the State of New Jersey

Division of Revenue on June 5, 2009, amended the business’s name to TG Fabulicious,

LLC.

64. Upon information and belief, TG Fabulicious, LLC operates an online

boutique that sells fashion items on a website entitled

65. The Defendant wife produced Lakeland Bank account statements in the

name of TG Fabalicious, LLC, for the period April 21, 2009, to January 29, 2010.

66. The Lakeland Bank account statements reveal deposits of $106,819.90

during the period April 21, 2009, to October 31, 2009, and $105,887.04 in debit card

purchases, checks, and other deductions during the same period.

67. The Lakeland Bank account statements also reveal deposits of

$192,620.90 during the three months after the filing of the Defendants’ petition.

68. Upon information and belief, the Defendant wife uses the Lakeland Bank

account as her own personal account, and commingles moneys she receives from TG

Fabulicious, LLC’s sales with moneys she receives from other sources.

69. The Defendants also produced a book contract between Hyperion and the

Defendant wife, pursuant to which the Defendant wife was to receive an initial advance

of $250,000, an additional advance of $30,000, and royalties based on sales of her

cookbook.

70. The Defendant wife’s contract with Hyperion was dated October 22, 2009,

approximately one week prior to the petition date, and was signed by the Defendant wife

on November 18, 2009.

71. To date, the Defendants have not filed amended schedules that disclose the

existence of the book “Skinny Italian,” the publishing deal with Hyperion, Defendant

wife’s ownership of TG Fabulicious, LLC, or Defendant husband’s ownership of 1601

Maple Avenue Associates, LLC.

FIRST COUNT

OBJECTION TO DISCHARGE UNDER 11 U.S.C. § 727(a)(4)(A)

FOR KNOWINGLY AND FRAUDULENTLY MAKING A

FALSE OATH OR ACCOUNT

72. The UST repeats and realleges each and every allegation contained in

paragraphs 1 through 71 as if set forth herein at length.

73. The Defendants signed statements attesting, under penalty of perjury, that

the information on the Petition, Schedules, and Statement of Financial Affairs was true

and correct.

74. The Defendants testified at their Meeting of Creditors and their Rule 2004

Examinations under penalty of perjury.

75. The original Schedule B, which the Defendants attested under penalty of

perjury was true and correct, failed to disclose Defendant husband’s bank account, two

pieces of real property, the Defendants’ vehicles, the Defendant wife’s pending book

deal, and certain business interests including TG Fabulicious, LLC and 1601 Maple

Avenue Associates, LLC.

76. The original Schedule I, which the Defendants attested under penalty of

perjury was true and correct, stated that Defendant wife was unemployed with no

likelihood of an increase in income in the near future, and understated her true income.

77. The Defendants knew that the information contained in their originallyfiled

Schedules and Statement of Financial Affairs was not true and correct.

78. Even after multiple amendments to their Schedules and Statement of

Financial Affairs, the Defendants still have not filed any amendments disclosing the

existence of the book “Skinny Italian,” the Defendant wife’s publishing deal with

Hyperion, the Defendant wife’s interest in TG Fabulicious, LLC, and the Defendant

husband’s interest in 1601 Maple Avenue Associates, LLC.

79. The Defendant wife testified at the Meeting of Creditors that she does not

have any interests in any businesses, which was a false oath in light of her subsequent

disclosure of her ownership of TG Fabulicious, LLC.

80. The Defendant husband testified at the Meeting of Creditors that the

filings with the Court had disclosed all of his business interests, which was a false oath in

light of his subsequent disclosure of his interest in 1601 Maple Avenue Associates, LLC.

81. The Defendants’ initial and amended Schedule I indicated that the

Defendant wife had no income on the petition date other than income from Sirens Media,

which was a false oath in light of documents indicating that she had pre-petition income

from operations of TG Fabulicious, LLC.

82. The Defendants intentionally did not disclose the existence of the

undisclosed assets in order to conceal their existence from creditors and the Case Trustee.

83. As a result, the Defendants have knowingly and fraudulently made false

oaths in this case in the form of false statements on sworn documents filed with the Court

and false sworn testimony provided at the Meeting of Creditors.

84. Wherefore, the UST respectfully requests that this Court enter judgment

denying the Defendants’ discharge under 11 U.S.C. § 727(a)(4)(A) and providing for

such other relief as is just.

SECOND COUNT

OBJECTION TO DISCHARGE UNDER 11 U.S.C. § 727(a)(2)(A) FOR

TRANSFERRING, REMOVING, DESTROYING, MUTILATING, OR

CONCEALING, WITH INTENT TO HINDER, DELAY, OR DEFRAUD

CREDITORS OR THE CASE TRUSTEE, PROPERTY OF THE DEFENDANTS

WITHIN ONE YEAR BEFORE THE DATE OF FILING THE PETITION

85. The UST repeats and realleges each and every allegation contained in

paragraphs 1 through 84 as if set forth herein at length.

86. The contract between Defendant wife and Hyperion indicates that, during

the year preceding the filing of the petition, the Defendant wife was in negotiation of a

book publishing deal for which she was to receive a $250,000 initial advance, a $30,000

additional advance, and royalties based on sales of her cookbook “Skinny Italian.”

87. Neither the Defendant wife’s cookbook nor the deal to publish it was

disclosed in any filings with the Court or in her testimony at the Meeting of Creditors.

88. The certificate of formation and Lakeland Bank statements for TG

Fabulicious, LLC indicate that, during the year preceding the filing of the petition, the

Defendant wife owned and operated a business that had a bank account into which over

$100,000 was deposited in the six months preceding the petition.

89. Upon information and belief, money received during the year preceding

the petition by Defendant wife from several sources was transferred to the TG

Fabulicious, LLC Lakeland Bank account and commingled with other funds to the extent

that it is impossible to separate property of Defendant wife from property of TG

Fabulicious, LLC.

90. Neither the Defendant wife’s interest in TG Fabulicious, LLC, the

Lakeland Bank account of TG Fabulicious, LLC, nor the income derived from TG

Fabulicious, LLC were disclosed in any filings with the Court or in her testimony at the

Meeting of Creditors.

91. The Defendant husband testified at his Rule 2004 Examination that he is

the sole member of 1601 Maple Avenue Associates, LLC.

92. Upon information and belief, 1601 Maple Avenue Associates, LLC had

income during the year preceding the filing of the Defendants’ petition.

93. Neither the Defendant husband’s interest in 1601 Maple Avenue

Associates, LLC nor any income derived from its operations was disclosed in any filings

with the Court or in his testimony at the Meeting of Creditors.

94. The Defendants knew of the existence of the cash and assets they failed to

disclose, yet they knowingly and fraudulently failed to disclose them on their Schedules

and amendments thereto, Statement of Financial Affairs and amendments thereto, and

testimony at the Meeting of Creditors.

95. The Defendants intentionally did not disclose the existence of the

undisclosed assets in order to conceal their existence from creditors and the Case Trustee.

96. As a result, the Defendants transferred, removed, destroyed, mutilated, or

concealed, with intent to hinder, delay, or defraud creditors or the Case Trustee, property

of the Defendants within one year before the date of filing of the petition.

97. Wherefore, the UST respectfully requests that this Court enter judgment

denying the Defendants’ discharge under 11 U.S.C. § 727(a)(2)(A) and providing for

such other relief as is just.

THIRD COUNT

OBJECTION TO DISCHARGE UNDER 11 U.S.C. § 727(a)(2)(B)

FOR TRANSFERRING, REMOVING, DESTROYING, MUTILATING,

OR CONCEALING, WITH INTENT TO HINDER, DELAY, OR

DEFRAUD CREDITORS OR THE CASE TRUSTEE, PROPERTY

OF THE ESTATE AFTER FILING OF THE PETITION

98. The UST repeats and realleges each and every allegation contained in

paragraphs 1 through 97 as if set forth herein at length.

99. Since the petition was filed, the book publishing deal with Hyperion was

signed, the cookbook “Skinny Italian” was released, and, upon information and belief, the

initial $250,000 advance was paid to the Defendant wife.

100. In addition, the Lakeland Bank account statements produced by the

Defendants reveal that TG Fabulicious, LLC had total deposits of over $190,000 during

the first three months after the petition was filed.

101. Upon information and belief, the book “Skinny Italian,” the Hyperion

book deal, TG Fabulicious, LLC, and 1601 Maple Avenue Associates, LLC are valuable

estate assets.

102. The Defendants knew of the existence of these assets as of the petition

date, yet they knowingly and fraudulently failed to disclose them on their Schedules and

amendments thereto, Statement of Financial Affairs and amendments thereto, and

testimony at the Meeting of Creditors.

103. The Defendants intentionally did not disclose the existence of the

undisclosed assets in order to conceal their existence from creditors and the Case Trustee.

104. As a result, the Defendants transferred, removed, destroyed, mutilated, or

concealed, with intent to hinder, delay, or defraud creditors or the Case Trustee, valuable

property of the estate after the date of the filing of the petition.

105. Wherefore, the UST respectfully requests that this Court enter judgment

denying the Defendants’ discharge under 11 U.S.C. § 727(a)(2)(B) and providing for

such other relief as is just.

FOURTH COUNT

OBJECTION TO DISCHARGE UNDER 11 U.S.C. § 727(a)(3) FOR

CONCEALING, DESTROYING, MUTILATING, FALSIFYING, OR FAILING

TO KEEP OR PRESERVE RECORDED INFORMATION, INCLUDING BOOKS,

107. The Defendants presented documents to the Case Trustee that purported to

be their 2006, 2007, and 2008 individual income tax returns.

108. However, upon information and belief, the Defendants have not filed

individual income tax returns for several years.

109. In addition, the Defendants have not produced financial statements and

bank statements for 1601 Maple Avenue Associates, LLC.

110. Furthermore, the Lakeland Bank account documents provided to date

indicate that the Defendant wife commingles funds from several sources, making it

impossible to separate the Defendant wife’s financial activities from those of TG

Fabulicious, LLC.

111. As a result, the Defendants have concealed, destroyed, mutilated, falsified,

or failed to keep or preserve recorded information from which their financial condition or

business transactions might be ascertained.

112. Wherefore, the UST respectfully requests that this Court enter judgment

denying the Defendants’ discharge under 11 U.S.C. § 727(a)(3) and providing for such

other relief as is just.

FIFTH COUNT

OBJECTION TO DISCHARGE UNDER 11 U.S.C. § 727(a)(5) FOR FAILURE TO

EXPLAIN SATISFACTORILY ANY LOSS OF ASSETS OR DEFICIENCY OF

ASSETS TO MEET DEFENDANTS’ LIABILITIES

113. The UST repeats and realleges each and every allegation contained in

paragraphs 1 through 112 as if set forth herein at length.

114. The Defendants’ Schedule F, as amended, reveals over $89,000 in credit

card debt.

115. Schedule B, as amended, disclosed only $1,000 in the Defendant

husband’s checking account, as well as household goods, furnishings, clothing, and

jewelry totaling only $24,550.

116. The Statement of Financial Affairs, as amended, did not disclose any gifts,

losses, or transfers of assets during the year preceding the filing of the petition.

117. As a result, the Defendants have failed to explain satisfactorily why all of

the cash and assets obtained by the Defendants from their credit cards are not now

available to meet the Defendants’ liabilities.

118. In addition, upon information and belief, most of the $106,819.90

deposited into TG Fabulicious, LLC’s Lakeland Bank pre-petition was received by the

Defendant wife in her personal capacity, and was not derived from the sales of TG

Fabulicious merchandise.

119. The Defendants have not satisfactorily explained why the money received

by the Defendant wife under her contract with Bravo, through her operation of TG

Fabulicious, LLC, and other sources over the past several years is not available to meet

the Defendants’ liabilities.

120. Also, as of the petition date, the Defendant husband operated at least seven

businesses, one of which was a stucco and stone contractor and the rest of which owned

rental properties with paying retail and residential tenants.

121. The Defendant husband testified at his Rule 2004 Examination that he

withdrew funds from his businesses as needed.

122. The Defendant husband affirmed his signature on a 2008 document which

indicated that he received $54,269 in monthly income from his stucco and stone

contractor business.

123. Upon information and belief, the operation of the Defendant husband’s

businesses generated considerable amounts of money over the past several years, some

portion of which was received by the Defendants.

124. The Defendants have not satisfactorily explained why the money

generated from the operation of the Defendant husband’s businesses is not available to

meet the Defendants’ liabilities.

125. Wherefore, the UST respectfully requests that this Court enter judgment

denying the Defendants’ discharge under 11 U.S.C. § 727(a)(5) and providing for such

other relief as is just.

    Fantastic blog. I was looking at the document and I noticed #23 of the petition says something about “in the 2 years since they filed”. Correct me if I’m right but wouldn’t that timeline prove that Teresa knew about their finances as she was shopping like Mrs. Got Rocks?

      The document is a wonderful thing! Can’t read to read it in its entirety. Lots of stuff I noticed from just skimming through: Teresa was/did receive $250,000.00 up front from her book, plus $30K and royalties, and has never disclosed this!! The 2005 Maserati was never disclosed either, maybe because it is a lease? Not sure how that figures into their (fraudulent) wealth. Awesome, and thanks to the trustee for not backing down.

      No. You are misconstruing Paragraph 23, which says:

      23. The Defendants did not disclose on their Statement of Financial Affairs
      any income other than from employment, trade, profession, or operation of business during the two years preceding the filing of their petition.

      When you file a petition for bankruptcy, you have to disclose all your assets, income, and debts and current income. There are a number of schedules for listing all this information, along with a Statement of Financial Affairs. On that Statement, the first question directs you to list all income for the two years prior to the calendar year in which the petition is filed.

        Damn that would have been great. Still I am certain she knew. If you saw her face when Andy was asking her basic questions, she was definitely lying. She looked extremely nervous and gave short vague answers that were almost a whisper.

        I think perhaps they felt that being on this tv show was automatically going to make them wealthy. She kept saying her daughter was going to be a star. I think they considered RH a jackpot of sorts.

        Also I can’t imagine ever spending like mad without asking my husband how much money was available. As dumb as Teresa is, I don’t buy her ignorance on this one.

        IMO they will stall with appeals but it looks like they are going down eventually.

    WSL – you asked where I got the court documents. Easy. These are public records. All federal court documents can be obtained from PACER.gov for pennies.

    No, I don’t know the judge and please everyone – do NOT contact the judge.

    I loved Kim Richards growing up (Escape to Witch Mountain and Tuff Turf in particular). I fully believe that she left under her own steam – for those of us at a certain age (probably 35-50), I would think we’d remember her.

      oh wow, I didn’t realise it was that same girl. I was a fan of hers too. haha I remember my girlfriend and I being the only two in the theatre for Tuff Turf. We loved James Spader and envied Kim’s hair so much.

      RHOBH looks like it’s going to be a good one. One thing is for sure, it can’t be worse than DC. Watching that show is like being stuck for hours in a waiting room with cold people you can’t talk to.

      I KNOW!!! I can’t believe that the Escape to Witch Mountain and Tuff Turf girl is Paris Hilton’s aunt AND a “Real Housewife”. I didn’t know Kyle was an actress too but she was on some random WTBS (remember when it was WTBS and not TBS) show called Down to Earth that was so bad, but yet I was addicted to it too. My tv standards have been low since I was a tween, LOL.

      This isn’t the first time the Escape to Witch Mountain girl shocked me. I was FLOORED she was in Tuff Turf too.

      She was in Meatballs II as well and lots of LIttle HOuse on the Prarie episodes too.

      I think her hair as a Real Housewife is as short as I have ever seen it. She always had that hair that was so long you could sit on it as a kid.

    Vilzvet – the Maserati was indeed leased. It was already repo’d and just recently, a motion was filed to release the restriction on the owner resulting from the bankruptcy, i.e., so he could sell it. I think the trustee agreed that it is not an asset of the estate.

    Wow.. if the court documents are true, Teresa comingled the money from her web site boutiques with her personal accounts. Neither paid income taxes for years. They gave the court copies of tax forms that were never filed. Joe just took money out of his companies as he needed funds. No wonder they fell apart.

      The IRS has to be aware since they are the ones that confirmed to the Trustee those returns had not been filed. I hope they are consulting with a good CPA and tax attorney because things are going to get hairy. How many celebrities have had to pay out big time due to tax evasion. I know Nicolas Cage recently had to sell real estate in New Orleans and other places to pay taxes. They probably would have gotten away with most of this and flown under the radar if it wasn’t for the RHNJ. I would say that karma is working as it should.

      If you read all the detail, you will see that Mr. Gorilla was pulling about 54k/month out of that business. Now remember, he had to pay his guys – the guys who hauled all that heavy stone around. He had to pay for the stone. He had to pay rent or mortage (the address was 393 Lexington Ave, Clifton which is one of the properties he oops forgot to list), property taxes, utilities, insurance, worker’s comp, etc. Assuming he paid all that, he still could pull 650k/yr out of that business?       The allegation has been made that he pocketed the rent from the slum buildings instead of paying the mortgages and other expenses on those buildings (including utilities).

          There is no criminal complaint pending (for perjury, fraud, or anything else) that I know of. So there is nothing to convict them of. But the U.S. Attorney could bring criminal charges if the facts merit doing so and if the U.S. Attorney feels it is important to do so. So many criminals, so little time.

          Here’s an excerpt of the statute:

          ITLE 18–CRIMES AND CRIMINAL PROCEDURE

          PART I–CRIMES

          CHAPTER 9–BANKRUPTCY

          Sec. 152. Concealment of assets; false oaths and claims; bribery

          A person who–
          (1) knowingly and fraudulently conceals from a custodian, trustee, marshal, or other officer of the court charged with the control or custody of property, or, in connection with a case under title 11, from creditors or the United States Trustee, any property belonging to the estate of a debtor;
          (2) knowingly and fraudulently makes a false oath or account in or in relation to any case under title 11;
          ……..
          shall be fined under this title, imprisoned not more than 5 years, or both.

          I am guessing that the auction is again off, because the authority to sell the assets of the estate emanates from the bankruptcy. If the trustee is trying to terminate the bankruptcy proceedings, then they wouldn’t want to take any other action under the bankruptcy until they know if the case is going to be dismissed or not.

And now the US Trustee’s office is also seeking to block the discharge, in its separate lawsuit. The two suits will probably be consolidated and proceed together.

          Hi, the auction will go forward, over the Giudices’ objection. That objection was resolved at the court hearing held on August 16. The auction has been rescheduled for October 3.

          The bankruptcy case will still go forward. The case trustee will still collect and distribute assets. It’s just that the Giudices may not get their bankruptcy discharge. In that case, for them, the whole bankruptcy would have been for nothing but the little breathing room (time) they got.

              they are entitled to keep limited assets, of limited value, just like everyone else that goes through bankruptcy – enough to re-start their lives with moderate clothing, furniture, modest car, etc. Luxury or high value items are often taken and sold, if there is equity in them.

              And yes, lying to a bankruptcy court, hiding assets in bankruptcy – these are federal crimes, very serious ones. People go to prison for that. It is up to the US Trustee (who filed the complaint in this blog post), in their judgment, to refer the matter to the US Attorney for criminal action if warranted.

That would be the logical thing to do if you won’t be able to get the discharge and you want to terminate the authority of the trustee to liquidate your assets. So you are right – they may be stuck at this point. Checkmate.

If these court documents are true (and Teresa and Joe do have the right to present their side in court, correct?) but these document make it look like Danielle is playing in the minors as far as lying compared to Teresa. These ladies all condemed Danielle for her criminal past but these are criminal offences, and they still support Teresa. Personally don’t see the logic in that. This is serious stuff.

    These criminals have gotten away with so much. This is obviously a way of life for them and a process they are familiar with and know how to work. I guess I won’t hold my breath. I think they will get away with it and will be handed their “fresh start”. Hope I’m wrong. . . . It would be interesting to know the background of the judge and see what ties or connections there might be. Maybe the Manzo’s are calling in favors for them. I don’t trust these people at all.

    HW BH – I don’t like that there are “trained” actors who will be part of the cast. This whole franchise is moving further and further away from “reality” and at some point you have to wonder to what extent are we (the audience) being played?

      I hear ya Kats2. It’s hard to have faith that the Gs won’t get away with this when they’ve suffered so little for so much. There have been few consequences for $11 mil worth of fraud, 2 DUI arrests, failure to pay income tax for 3 years, multiple arrest warrants on Joe… But, doesn’t that seem very odd? Especially 3 years of no income tax on multiple businesses. I own a business and I’ll tell you, the IRS does not miss a thing. Based on no information and just a gut feeling, I think the Gs are under investigation for much bigger crimes, possibly at a Bureau level. It’s impossible to believe that these 2 morons could have ever legitimately earned enough to qualify for the amount of credit they received, even with Joe’s folks kicking in thousands a month and even with with the lax mortgage loan practices a few years back. And, now a pizzeria – give me a break. That’s not a big money maker and totally outside his previous business experience, but also low profile and a perfect front business for other kinds of transactions. This is much bigger than what we know about so far, imo. I’d love to see some real jail time, but not getting my hopes up either…

    no way that the Guidice’s will be granted the Chap 7 bankruptsy. “I forgot” doesn’t work in court and there are enough counts to take them down. The IRS won’t be far behind and IMO they will also go after the “family members” who have been gifting them….this is the tip of the iceberg they tried to hide!

          The jewelry claim thing is from a blog (don’t remember which) that had a copy of the statements in bk court that the jewelry must have over appraised the jewelry for their insurance claim. I’ll see if I can find the article.

          The house in Italy that she claimed to own was during the RHONJ show on camera.

          Since they hid other homes why not Italy. Even if it is co-owned with other people or time share or inherited property it is still an asset.

  33. Anyone notice that Teresa even lied about her salary? The revised amount is almost $8 grand an episode, for last season. The amount that they owe went up also.
    So-looking-around the www, the most interesting thing to me is that someone posted the idea that Teresa’s little niece is also in show-biz, and is actually talented. That would be one more reason for Teresa to be jealous of Melissa. Oh-and the photos of Melissa’s home vs. Teresa’s are a don’t miss. (link upthread)
    I don’t see any way out for Teresa & Joe unless they pack-up and go back to Italy.
    Even if she gets a raise and stays on for season III, she’s looking at a world of trouble & bills. I’m pretty sure that her bank acounts can be seized, and Bravo doesn’t pay in cash the last time that I checked.

      I think the document said almost $8k per month, not per episode. They get paid when the episode is filmed, not when it is aired. So they might have filmed 25 or so episodes in calendar year 2009.

      I suspect that Teresa and Joe will be paying off the debtors for the rest of their lives. The government will not allow them to wipe the slate and start fresh. Plus, the IRS doesn’t care if Teresa is a star. They want their money and penalties.

      All of the housewives have to pay lawyers, hair and makeup assisstants, drivers for the limosines, fashion stylists and assistants. The just don’t make enough to warrant these expenses.

Not sure if this is true but have read many commentors stating that her husband owes many people thousands of dollars. I am sure all the facts will be coming out shortly.

She is trying to deny M/M Gorilla discharge. That means everything that is not exempt can be liquidated to pay creditors, but M/M Gorilla will still owe the balances (which will be most of it because their craptastic crap has very little value). And then the creditors can come after everything – property, houses, businesses, income, the works.

      Just a possibility but…..I’m a bankruptcy attorney and the “private sale” could easily be the Guidices offering a sum of money to the Trustee to “buy back” the Trustee’s interest in their personal belongings. I have this happen regularly in my Chapter 7 cases where the debtors owes an asset that is not protected by an exemption and the Trustee wishes to have the asset liquidated. The Trustee can instead reach an agreement to allow the debtor to buy back the asset. Generally the Trustee will only agree if the debtor is willing to pay fair market value for the asset.

          I don’t think there ever were any family contributions. I think it was just an excuse for having enough money to buy all their crap without having claimed individual income to be taxed or attached. I also don’t think TG Fabulicious was ever meant as a legitimate business that was promoted, staffed, etc.. It was set up as a place to deposit cash that could then be spent just as quickly. If they’d filed income tax returns on that business, they would have owed next to nothing because they would have declared all the personal spending as business expenses and there would be little net income. That was the plan, imo. They were disorganized and desperate to avoid liquid assets being attached by creditors and the businesses they owed before they could spend it. By the time they decided to file for BK, they were into deep and had to decide whether to file transparently fraudulent tax returns on TG Fab and the neglected properties, or not declare them at all and later claim ignorance if they were discovered. Two bad options, they picked the latter. Just my theory. They’re so screwed…

    I sure wouldn’t want to be in T’s shoes right now. I’m sure they thought they could outsmart everybody and walk away clean. To think that someday when her girls are teens and they Google their name all this is going to jump right out at them is disgusting. I can see why she didn’t want her sil to be a HW, she didn’t want us to know that she was the poor one of the family. I think she’s so jealous of her brother and his wife that it’s killing her.     I’m speculating, but I think that D is leaving the show on her own accord. I think her ex-hubby basically paid her off to have the girls live with him and have her give up the show for a boat load of money so that she can start over somewhere (NYC perhaps?). I don’t know why, but I just have a feeling that the dealings with her ex-husband are figuring more prominently in her life at the moment than the RHONJ. Anyone else think so or is my tin foil hat on too tight? 🙂

    Not a lawyer, but I expect the next step for the Grifters will be accusing their accountant of malpractice, their attorney of “inadequate representation,” etc. If they do dismiss their bankruptcy attorney (or if he walks), does this buy them more time? How long could things be strung out in this manner? Seems like it happens all the time in litigation–are we looking at years of due process?

          Its not like the Manzos did that to someone-it was done to someone in their family.
          I’m not an unconditional Caroline supporter–the word, “shaved” was a good clue, and they could have put some cute ones, but personally I have the opinion that “tiny” Manzo could have been offed for refusing an offer that he shouldn’t have refused, or that he refused to pay tribute, or some other non-action–I could be wrong, but aside from being whacked Mob-style, and having and old school Mob nickname, and being Italian, I haven’t seen any evidence that he was connected.
          I noticed in the car-wash/strip-club episode, Albert was far more friendly & warm to the Indian car wash guy than the seedy strip-club owner. He was polite about the strip club, but that was it.
          I wouldn’t put it past his dad, who would be “tiny” Manzo, to be the same kind of businessman who tried to avoid any sleeze?
          Unlike Danny Provenzano, who served time for racketeering & has the Mob pedigree.

            While I agree, I don’t think Albert (Caroline’s hubby) is involved if what Danielle says is true that they have friends under ‘federal indictment’ the probably aren’t just hanging out with the pillars of the community.

    Lap-Band is suggested for people who have to lose a lot of weight. On the first show of the season, Caroline went shopping with Albert to buy him new clothes (since he lost so much weight). Perhaps she was struggling to lose weight and found a doctor to do the same procedure on her. She is definitely much smaller than she was at the beginning of the season. These are all rumors, of course. But all the hints point to her. It is on a lot of gossip sites today as a blind item.

    I would watch NJ again if Teresa’s sister-in-law really is part of the show just to see how these 2 would deal with each other. I bet the sis-in-law could give some pretty interesting personal tidbits that I’m sure T would hate to have revealed.

    I am bored with the DC ladies already, nothing to say about this really. Can’t wait until it is over.

    I am looking forward to Beverly Hills mainly because of the Richard sisters. Lynn, you mention you haven’t heard of them before acting-wise, but I remember them and actually liked them as child actors. The blond Kim did the Disney Witch Mountain movies (that is the most memorable thing I can think of) and I saw a movie in the 70s when she was a teenager with James Spader, nothing else I can recall seeing. Kyle I remember from Little House on the Prairie; she was the stepdaughter of Mr. Edwards, and I also remember a sitcom on cable about some angel coming to earth to be a housecleaner for a family, and she played the daughter (great premise, huh?). She also played a regular nurse on ER for quite a few years of that show’s run. I am really dating myself….

    I saw a bit of the preview where it seems these 2 have some major issues with each other and other ladies, so I am a little disappointed as I was hoping for better things with them, but will definitely watch.

    I haven’t gotten around to reading all the comments yet, so forgive me if I am repeating information already mentioned.

    And just what does this brother do for a living that allows him to live like a king in another over the top mansion loaded with piles of crap that is on display for us to envy? Someone mentioned that he is in real estate. From my reading of the news this is one market that has been totally hit by the economic downturn to such a degree that foreclosures have never been as high since the Depression and not one indicator is showing that this will change much in the next two years at least.

    What is wrong with that entire family that they are willing to shed their self esteem and land a show whose sole purpose is to expose them for their financial shenanigans and their propensity for violence? This is entertainment?

    Shady people with questionable sources of income should not be held up to the public and called “stars”. Don’t mean to moralize but I have had enough of this outrageous display of programming showcasing idiots.

        These are Bravo’s offerings. Two members of the cast of BH are warring sisters who apparently don’t like one another so why not throw in another “storyline” that matches this one?

        We had the “best friends” feud with Jill and Bethenny followed by the “let’s all hate on Danielle” with the NJ outing and DC offers “everybody hates the Salahi’s” as proof that as far as creativity goes there seems to be a limit. Give Teresa someone to “hate on” and the “story” unfolds.

        Just follow the same outline for all franchises and throw in a bevy of bleached, Botoxed, breast enhanced bimbos and lo and behold, “drama” ensues.

    Just reading net. Dina has an article complaining that Danielle crossed the line by bringing up Dina’s child. However, Jacqueline brought up Danielle’s husband’s opinion of Danielle’s parenting and the Staub children crying in the nurse’s office. Those happen off of the show. The Manzos brought up the book and bad behavior of Danielle 25 years ago. Jacqueline and T met with Danielle’s first husband for dinner and have been involved in the civil suits from the first husband and Steve, the boyfriend. I think Danielle brings up something and the group smacks her down. They do the same and they support each other. I don’t like sociopathic Danielle, but how do to deal with that group?

      Well now we know just how bargain basement Playboy has become.

      When Sasquatch posed (what 18 years ago, except for the cover, which had a large piece of fabric covering her deformed torso) I thought to myself that Playboy had really sunk to the bottom. They are publishing only 10 issues per year, Playboy Enterprises is up for sale for $300 mill and the only bid $210 mill. The stock has been as low as $4/share and the shareholders are suing Hefner (who holds about 70% of the stock).

      Meanwhile the demented Sasquatch is blathering on about being honored to be in so prestigious a magazine and claiming it went to 250 million people (when what went to 250 million people, if anything, was promo pieces, not the mag itself). The magazine’s current subscription in the U.S. is about 3 million and worldwide about 4.5 million.

      So now they are going to feature another freak. Maybe they should just have a pictorial – the Freakish Women of Bravo – and be done with it. Maybe Lauren Zalaznick should pose, too. And you know that Gretchen will be first in line, TamRUH not far behind.

    also, on thursday I took my 99 yr old dad for his “mussels” fix at Gio’s ,the resturant in macungie pa where theresa had her book signing. (my friend from pa went to it and said there were at least 400 people there at $20 a pop. you got her book and her autograph for that. my friend said she is much prettier in person and very sweet. GRIFTER!) anyway, when I was there for lunch the owner overheard me pumping the waitress for dirt on t and he said they are best friends(that’s why the venue for the book signing) they met on a cruise 10 years ago and he was at all the televised parties etc. they were also at t’s shore house last weekend and said joe is NOT stressed out about the bankrupcy, but he did say he hopes joe “is not doing anything”(affair) because it will definitely come out. he just kept saying over and over how sweet t is and how adorable and NOT bratty the girls are. of course, that”s not what I wanted to hear! I need gossiiiiiipppp! their mussels are fantastic, however!

    But what I found interesting was that the property backs right up to a major state 4 lane highway – Route 287. And for all of us that live in NJ – Rt. 287 is a busy one. So it has to be noisy – at least when you are outside. Go to:

    I just finished reading the article about Bethenny in Us Weekly. I know someone posted this yesterday but it is worth repeating, a source for the article states that Jill and Kelly have been reduced to part-time. Another source said that Kelly is fine with the situation but Jill is another story. The “source” thinks that this is going to be a blow to Jill’s ego because she thought she would be the center of attention with Bethenny gone.

    Bethenny stated in the article that she thought that Jill’s apologies at the reunion were sincere but Jason thought it was just for the cameras. Bethenny said she hasn’t heard from Jill since the reunion. I found that interesting because Jill claimed that she called Bethenny after the reunion and she said that Bethenny didn’t return her call. This reminds me of when Jill claimed that she sent Bethenny a baby gift in one interview but in another interview she said that she bought Bethenny a baby gift and she will give it to her when she sees her. Jill can’t keep up with her lies.

    I was disappointed to read this in the article, Bravo hasn’t announced a second season of “Bethenny Getting Married” but Bethenny said if she were a betting woman, she would say that it will get renewed. I kept reading articles online that there would be second season. I guess we will have to wait and see. 😦

      IMO – Kelly wouldn’t care if she was part time on RHONY – she can still say she is on the show and she can go back to those annoying walk on walk off I’m at a fabulous party filler shots. She doesn’t have anything real or interesting to add and it is doubtful that the other housewives (particularly Alex and Ramona and maybe Alex) would want to film with her for anything more than a greeting at a party.
      As for Jill – her ego has to be exploding with rage! Part time?! Part time?!! Well dear – when you put your personal agenda above Bravo’s, when you encourage another unstable cast member to go postal, when the majority of the cast doesn’t like to be around you and when you say at the reunion you won’t film with Alex – you get what you give……part time IMO is too much time for the likes of you!     Thanks to @Had Enough and @JustAnotherJerseyGirl for the good insight here yesterday- learning a lot. For all our legal minds, it is my understanding that the Gs filed Chapter 7. Wondering what could happen next?

    1. Since the US Trustee is petitioning against the discharge of their debt (yeah!), is it possible that they will be forced into Chapter 13 and be liable to pay off their debts over time?
    2. How likely is it that one or both of them will be prosecuted for perjury for lying under oath to the bankruptcy trustee? Does this ever happen?
    3. With all the red flags in the personal bankruptcy, will the IRS likely start (or continue) looking into their business income taxes too? This is where I think the trail will lead to a web of illegal activity that could ultimately result in a criminal prosecution.

      1) Trustees can determine that Chap 13 is what will happen (since Teresa has an income stream (show, book, appearances, etc) a payment plan for what the trustees determine will be repaid could happen. 2) it is very possible that when the US and NJ trustees combine their paperwork this would happen. 3) IRS has alot of money to collect, with penalties, so don’t expect them to go away!

      Teresa and Joe have both lied under oath and have hidden assets and income, plus comingled funds to the extent that neither one of them can untangle themself from the total mess. When someone is petitioning with honesty and openness they are treated respectfully – these clowns have unfortunately believed it was just another con and underestimated the power of both the NJ and US trustees, their lawyer is not a very good one because he should have checked their petition before it was submitted (from read the latest document it seems many key requests were not done up front) so he may just be good at drawing this out so they can continue to live in the mcmansion for as long as possible. IMO what they have not realized or have maybe disregarded is that they will not be in the position to get easy money through legitimate channels in the future (loans, mortgages, credit cards) and the fresh start means more than just dumping debt, it means living within your means!

I’m also thinking there’s probably a much bigger investigation of Joe’s business transactions underway. Any way it would live in NC & my brother would use it. When I am here I am offer a large(red neck) truck or a convertible rabbit that leaks in the rain.
    I had trouble seeing out of the camero. I haven’t had a test drive 4 the other.

      WSL- Boston is similar to NYC in that there’s non existent parking. So no car for me, I’m on public transportation. I have groceries delivered, and for the most part takes cabs when it’s after hours. The medallions are restricted here, unlike NYC so the cabbies are in tough competition for fares, so usually no probs.

      I love Saab – have an 89 900Turbo and an 04 9.3 Turbo ragtop and drive them six months each (a winter and a summer car) both stick shift and I have neglected to teach either my husband or sons to drive…. We also have an 08 Ford Escape for errands and a 10 Malibu for my teenager to wreck, oh I mean drive to school. I tested a Hyundai Genesis and that was a nice sedan that was appointed well and had the power I prefer.

      And my first car was a 68 Malibu SS (California Competition 4 on the floor) ragtop!

    4. in july teresa had a party at nightclub 4sixty6 with her girlfriends and ran up a tab for bottles of liquor and dom perignon and while her friends assumed she would be paying, she expected someone else to pay and in the confusion they almost dined and dashed! yeah right, confusion!

    5. she admits that joe kept her in the dark about their finances and if she had known she would have changed her over the to spending..bullshit..and they wouldn’t have to auction off their wedding bands! huh.

    6. finally, a psychiatrist said all of this, auctioning off their belongings, depending on her husband to keep her in a lavish lifestyle, etc. is a recipe for divorce.

    Taxes cannot be forgiven in a bankruptcy! You can go BK and still owe huge taxes. I’m not sure what the law is on state and county taxes, but I am sure the G’s will be paying Uncle Sam (no, not the father of the mystery nephew) for years.
    Couldn’t happen to a nicer couple.

      You also have to file your taxes to quality as a debtor for relief under the bankruptcy code. Failure to do so can result in dismissal. I found it interesting the US Trustee did not include a count for this (that I saw). I suspect its because they would rather have a denial of discharge under 727 for the Guidices.

    WSM said presenting un filed tax statements under oath is a grave mistake. The problem is the court has to PROVE fraudulent intent. J& T as has been said b4 will blame their accountant & anybody else that they can.
    One hope is that since Madoff there has been a sea change & a huge attempt to crack down particularly on public fraud & to make an example for others. NJ recently was the first state to b charged for fraud in the state pension plan which had previously been regulated by the state not the SEC. NJ needs to save face w/some head line convictions.
    This is kinda a high profile (not high brow)case & I believe the odds r the court will make an example out of M&M Gorilla.

    Boston, the cabs are one of the many reasons I love you city. I travel there frequently for work (I was just there last week), and I can always get a cab in minutes. Boston is just such an amazing city.

    As for personal vehicles, I have two and they are on opposite ends of the spectrum.

    I have a Lincoln Navigator and she is big, black, and beautiful! I got her off someone’s 3-year lease and it has every bell and whistle imaginable. With two kids and a 150 lb dog you need a big vehicle. If I didn’t work from home I don’t know if I would have gotten though because of the gas millage.

    My 2nd car is my first true love. I have a tiny 1979 red MGB. She has broken down in every state she has ever been in, tried to kill me once when her hood latch broke and the hood came flying up and hit me in the head, but I still love her. I got her for my 16th birthday and swore I would never part with her.

My father did not want me in it & the firt time as he had promised ,he took it away & put me in a “safer new car” my Checelle SS. I later learned it wasn’t a SS my Dad had just stuck the SS emblems on the car b4 I got it to shut me up. I was a very spoiled brat. The SS still gave me” respect on the road” 🙂 I loved that car.

      My dad used to get so pissed at my friends and I as we would swap cars for the weekend – a BGM Midget, a Triumph, an Austin Healy, a Porsche 914 and a mustang in rotation. Those were the days of little imports and American muscle (camaro, firebird, mustang, malibu, 442s) – cars aren’t anywhere near as much fun today! (heavy sign) I did test the new camaro and honestly can’t say it is better than the original and it is priced out of the younger persons budget as well.

        You gotta love those cars! My family is a true car family. My dad has a small collect of Corvettes and at one point his goal was to have one of every major body type. His interest faded but he still has a few. My favorite is his 62. Black, all numbers match, and the wonderbar radio still works. He keeps telling my daughter (who is 13) that she can have it when she turns 16. Yea, I don’t think so. This weekend my dad is racing at Summitt Point in WV in the Pro IT series. He is 67 and got his SCCA racing license last year. He is am amazing man.

    I love it when you all talk sexy car talk. For me it should only have a motor, 4 tires and start when I put the key in the thingamajig. To me, that’s heaven. WADDAYA WANT, I USED TO HAVE A BUG TO PICK UP 4 KIDS , 2 DOGS AND A CELLO. Sorry I screamed, when I think of those days I still go nutso. We looked like a bunch of hillbillies but that was what I could afford. A whopping $1,965. It was freedom to me and laughs for the entire township.

      I think she might have left the teeth alone, but had Botox injections above the upper lip so that it won’t go up so high exposing her gums. much cheaper and non invasive too.

      I CANNOT stand this woman’s eyebrows! You have a teeth ” thing” I have an “eyebrow” thing.

      Caroline draws the ends of her eyebrows on and then draws them down so it closes up her eyes.

      I really don’t like any of the NJHW eyebrows, if they were done right it could take 15 years off them. (don’t even get me started on Danielle’s)

    I was a make-up artist for years. The beginning of the eyebrow should start at the inner corner of your eye, the arch should be over the pupil and it should end at the outer corner of your eye. Thick or thin is preference.

      Try an arch if you haven’t already, pluck a few under the eyebrow right above your pupil when you look straight in the mirror. Go slowly and even up the other side as you go. Not too skinny!

          you know I did it for so long, and whenever the economy tanked I went back to it, that I lost my joy in making women over. I really did it to make money, and found I could sell better and to more woman when I stopped doing makeovers as a sales tactic.

          but WSL is right, the way to excel is to really believe in what you do, and to sell with integrity by not overselling your product.

          I do miss the comraderie though, and I miss the CHARACTERS I worked with.

    go to twitter.com, then use the search (at top, you’ll see it) type in the person’s name or twitter name if you know it. I just did “teresa giudice” and it brought up the stream of twitters that people are sending.

    Okay, now it you want to go to Teresa’s twitter, just do this

    So there’s 2 ways to do it. twitter.com/anybody’s name or twitter address to find their page; the other way to get what people are tweeting them. someone posted up thread a way to see convo between 2 people. that sounds interesting.

    Kyle was a child actress. She may have not have had Gary Coleman success, but she has some notable credits such as Little House on the Prairie (she played Mr Edwards daughter Alicia) the movie Halloween, and guest roles on shows that were popular then, like Chips, Fantasy Island, etc.
